Membership Agreement

Here is how everything works. We keep it simple.

The Founders Deal

Founding Price Lock

Your founding monthly price stays the same while your membership remains active and in good standing. If you cancel and later rejoin, the then current rates will apply.

Founding Plans Overview

  • • Plan-specific details (price, included credits/benefits, and any minimum commitment) are shown at checkout and on our Pricing page
  • • Some plans include unlimited classes (limit 1 per day) and guest passes; others are credit-based with credits that expire each monthly cycle
  • • After any minimum commitment, you may cancel anytime with 7 days notice

These founding prices are limited. After founding memberships sell out, regular pricing applies as posted on our Pricing page. Members who secured a founding rate keep it while their membership remains active and in good standing.

Opening and Billing

  • • We are opening in December 2025 in Pleasant Grove, Utah
  • • Your payment today holds your spot and locks your price
  • • No additional charges until 30 days after opening
  • • If we open later than planned, your billing start adjusts automatically

Pre-Opening Guarantee

If we are not fully open and operating public classes by January 1, 2026, you may request a refund of your initial payment. To request a refund, contact us in person at the studio or email [email protected]. No other charges will run before opening.

How Classes Work

  • • Unlimited means 1 class per day for Unlimited members
  • • Class Pack members receive 4 classes per month. Credits expire at the end of each monthly cycle and do not roll over.
  • • Unlimited members can book up to 30 days in advance
  • • Class Pack members can book up to 15 days in advance
  • • Late cancel less than 12 hours before class: $8 fee
  • • No show: $18 fee
  • • Grip socks are required. We sell them at the studio.

Class Changes, Waitlist, and Closures

  • • Classes, instructors, and times may change or be canceled. When possible, we will notify you by email or app notification.
  • • If a class is full, you can join the waitlist. If a spot opens more than 12 hours before class, you may be auto-added and notified. Remove yourself if you cannot attend to avoid fees.
  • • We may temporarily close part or all of the studio for cleaning, repairs, maintenance, events, or reasons beyond our control. We will give notice when practicable.

Payments

  • • We use Stripe for secure payment processing
  • • Your card is charged automatically each month
  • • If a payment fails, you have 7 days to update your card
  • • All prices are subject to applicable sales tax
  • • You authorize us to charge your payment method for all applicable fees

Automatic Renewal and Cancellation

Memberships bill monthly until you cancel. Renewal and cancellation terms are shown at checkout. You can cancel at any time to stop the next billing cycle using any method listed in How to Cancel. If a fixed term promotion includes an automatic renewal, we will send an advance reminder.

Need a Break

  • • One complimentary membership pause of up to one (1) month per calendar year
  • • Submit your request at least 30 days before your next billing date; pauses cannot be backdated
  • • No additional elective pauses beyond the complimentary pause
  • • Medical or injury holds may be approved with supporting documentation; duration is at our discretion
  • • Any pause or hold extends any minimum commitment and your billing renewal date by the same number of days
  • • Class Pack credits and expiration dates do not extend during a pause; Unlimited members may not attend or book classes during a pause

Canceling

  • • Any minimum commitment period is shown at checkout
  • • Provide at least 7 days notice before your next billing date
  • • Email us at [email protected]
  • • No refunds for partial months

Your 3-Business-Day Cancellation Right

You may cancel your first purchase without penalty before midnight of the third business day after the date of purchase. Email a signed notice to [email protected] or mail it to Park Pilates Club LLC, Pleasant Grove, UT 84062. We will refund all amounts paid, less the reasonable value of any services you used before cancellation.

Your cancellation is effective at the end of your current billing period unless your plan terms state otherwise.

Eligibility, Health Disclosure, and Assignment

Membership Eligibility

Membership is for adults 18 and older. Ages 16 to 17 may participate with a parent or guardian signature and must follow these Terms.

Health Disclosure and Right to Refuse Service

Tell us and your instructor about any condition that could affect safe participation, including pregnancy, recent surgery, cardiac or orthopedic issues, respiratory issues, or other health concerns. We may refuse or discontinue access if, in our reasonable judgment, participation poses a material health or safety risk to you or others.

Assignment

We may assign this agreement to a successor or affiliated entity that continues substantially similar services.

Health and Safety

Classes can be physically demanding and involve the use of resistance equipment. You are responsible for working within your limits and following instructor guidance. If you feel pain, dizziness, or discomfort, stop and alert the instructor.

Adult Waiver

By participating, adult members and adult guests release Park Pilates Club from ordinary negligence to the fullest extent permitted by Utah law. This does not waive claims that cannot be waived by law.

Hands-On Adjustments

Instructors may offer brief hands-on adjustments to assist with alignment and safety. You can decline or withdraw consent at any time. Tell your instructor before class or email us and we will note your profile.

Kids Lounge - Please Read Carefully

⚠️ THIS IS NOT CHILDCARE ⚠️

The Kids Lounge is completely unsupervised. You remain fully responsible for your child at all times.

Kids Lounge Conditions

  • • Parent or legal guardian must remain inside the building and be reachable within five minutes
  • • A single child’s time in the lounge is limited to 1 hour per day
  • • Use is occasional and not a regular childcare schedule
  • • Child must be fully potty trained. No diapering in the lounge
  • • No meals are prepared or served in the lounge

The lounge is next to the studio but not visible from the reformers during class. Classes may have up to 9 adult participants.

What it is

A room with a TV, toys, and seating where children can play while you work out nearby. It may include a live, in-room video display for parent awareness. The feed has no audio, is not recorded. It is provided as is with no supervision or childcare services.

What it is not

  • • Not a childcare facility
  • • Not supervised or monitored by staff
  • • Not staffed with attendants
  • • Not licensed for childcare services
  • • Not responsible for your child’s safety or well being
  • • Live video is for parent awareness only and is not staff supervision or childcare

Age Requirements

Children must be between 3 and 10 years old and:

  • • Fully potty trained with no diapers or pull ups
  • • Able to follow basic instructions and rules
  • • Capable of playing independently for 45 to 60 minutes
  • • Healthy and well behaved

Parent Supervision and Class Format

You remain responsible for supervising your child at all times. Because the lounge is a separate room, you cannot see or hear your child from your reformer during class.

  • • You may leave class at any time to check on or assist your child
  • • Class disruption is acceptable for child safety

No Staff Supervision

Staff may pass through for cleaning or facility checks. This is not supervision and does not transfer responsibility for your child. Staff do not monitor the live video feed.

Your Responsibilities as a Parent

  • • Remain on the premises the entire time your child is in the lounge
  • • Be immediately available and reachable within five minutes
  • • Ensure your child follows the rules and plays safely
  • • Accept responsibility for injuries your child causes to others and any property damage
  • • Remove your child immediately if disruptive, sick, or unable to remain safely

Kids Lounge Facility Fee

There is a $3 per class Kids Lounge Facility Fee when using this amenity. This fee covers maintenance and supplies, does not constitute childcare, and is non refundable once your child enters the lounge.

Owner and Staff Gated Area

The Kids Lounge includes a gated section for owner or staff use. The owner or family members may be present in this gated area while the lounge is in use. This does not constitute supervision of other children.

Kids Lounge Rules

  • • Be healthy and well. No sick children
  • • Wear clean socks or grip socks. No shoes
  • • Stay in the Kids Lounge area. No wandering in the studio
  • • Play quietly and respectfully
  • • No food or drinks in the lounge. Water is allowed only in a closed container
  • • No rough play, running, or dangerous behavior

Health and Safety

  • • Parents handle any medications
  • • We are not trained in childcare or child development
  • • At least one instructor on duty is CPR and AED certified during class hours
  • • In an emergency, if we become aware of an issue, we will attempt to contact you immediately and may call 911. Because the lounge is unsupervised, you should be prepared to call 911 yourself if needed.
  • • You are responsible for all medical costs arising from injuries in the Kids Lounge

Prohibited Items

  • • No food or drinks other than water in a closed container
  • • No toys from home
  • • No electronic devices. We provide entertainment
  • • No items with small parts that pose choking hazards
  • • No sharp objects, weapons, or dangerous items

Capacity and Age Mixing

The Kids Lounge has a maximum capacity of 6 children at one time. Children ages 3 to 10 may be present together. Parents acknowledge that mixed ages carry inherent risks of accidental injury.

Emergency Medical Authorization

Use of the Kids Lounge authorizes Park Pilates Club to call 911 if immediate medical attention appears necessary, provide emergency responders with your contact information, and take reasonable steps to protect immediate safety until you arrive. You are responsible for all costs of emergency medical care. We do not supervise the lounge, so we may only become aware of an issue if another parent alerts us, a child comes to the desk, or a staff member notices a problem while passing by.

Incident Notification

  • • Major incidents: we will call you out of class immediately
  • • Minor incidents: we will notify you after class
  • • We document significant incidents for our records
  • • A live, in-room video display is provided for parent awareness; it has no audio, is not recorded, and is not monitored by staff

If you are not comfortable with these terms, please do not use the Kids Lounge.

Alternative: arrange for childcare outside the studio or bring your child to class when they can be supervised directly by you.

Personal Property

Park Pilates Club is not responsible for lost, stolen, or damaged personal belongings. Please do not bring valuables to the studio. We provide cubbies for convenience, but they are not secure storage.

Media and Communications

Photo and Video

By joining Park Pilates Club, you grant us permission to use photographs, videos, or other recordings of you taken at the studio for marketing, social media, and promotional purposes. If you prefer not to be photographed, notify us in writing at [email protected]. We use a live, in-room video display in the Kids Lounge for parent awareness only. The feed has no audio, is not recorded, and is not monitored by staff.

Text Messages

By providing your mobile number, you agree to receive class reminders, schedule changes, waitlist notifications, and account texts from Park Pilates Club. Message and data rates may apply. Message frequency varies. Reply STOP to opt out, and HELP for help. You can also opt out by emailing [email protected].

Studio Etiquette and Rules

  • • Arrive 10 minutes early to your first class
  • • Grip socks required. No shoes in the studio
  • • Silence your phone during class. Keep it on vibrate so we can reach you if your child needs you
  • • Be respectful to instructors and other members
  • • Wipe down your equipment after use
  • • No outside food or drinks. Water bottles are welcome
  • • We may terminate memberships for behavior that disrupts the studio environment

Membership Transfers and Sharing

Memberships are non transferable and for your personal use only. You may not share, sell, or allow others to use your membership. Violation may result in immediate termination without refund.

Dispute Resolution

Any dispute between you and Park Pilates Club will be resolved by binding individual arbitration under the Utah Uniform Arbitration Act and the Federal Arbitration Act, administered by the American Arbitration Association. Either party may bring an individual claim in Utah small claims court. No class or representative actions. You may opt out of arbitration by emailing [email protected] within 30 days after your first purchase. If the arbitrator finds your claim is not frivolous, we will advance any administrative filing fees beyond what you would pay to file in a Utah court.

This agreement is governed by Utah law.

Changes to Terms

We may update these terms to reflect changes in our policies or legal requirements. We will email you at least 30 days before any material changes take effect.

Founding Price is not affected by changes to these terms as long as your membership remains active and in good standing.

Continued use of your membership after changes take effect means you accept the updated terms.

Entire Agreement

This agreement constitutes the entire understanding between you and Park Pilates Club and supersedes any prior agreements or communications. If any provision is found unenforceable, the remaining provisions remain in full effect.
